Wyoming is severely lacking in legislation that protects borrowers from predatory lending practices. For consumer loans, no maximum interest rate is given, except in the case where no written contract was signed. In such instances, Wyoming Statute 40-14-106(e) stipulates that the interest rate will default to seven percent per annum. Otherwise, interest rates are whatever the lender and borrower agree to. For payday loans, which are small amounts borrowed at high rates over short periods, there are some stricter terms, but far from sufficient to protect borrowers from being cheated out of their money.
Wyoming Statute 40-14-362, which governs payday lending, does not set a maximum amount that payday lenders can offer to borrowers. The most that borrowers will have to pay back their money is one month, and finance charges are capped at either $30 or 20% of the value of the loan, whichever is greater. That allows payday lenders to charge what equates to a 780% APR. On the positive side, the law forbids rollovers, nor can borrowers use a new loan from the same vendor to pay off an old one. However, borrowers can simply go to another payday lender to get a fresh loan, perpetuating a cycle of debt.
