Wisconsin Residents are Carrying a Heavier Financial Burden

You’d be forgiven that thinking Wisconsin residents are doing just fine. After all, the U.S. Census Bureau estimates for Wisconsin in 2017 showed that the populace was doing very well. Household income averaged about $56,759, the poverty rate was only 11.3%, and 66.8% of the population was in the labor force. On the surface, Wisconsin is doing far better than many other states. But what Wisconsin residents realize, that many others don’t, is that they’re doing far worse than they could be. This is because of a new law that was passed in 2011, called Wisconsin Act 10.

The brainchild of former Governor Scott Walker, the law was passed in an effort to curb a $3.6 billion deficit in the Wisconsin budget. The law sought to offset expenses by passing more costs to the residents working for both state and local governments in Wisconsin. Some these increased costs include a 5.8% contribution to retirement pensions and covering up to 12.6% of health coverage premiums. Additionally, the law severely limits collective bargaining rights for workers unions and prohibits limited term employees from accessing employer-sponsored health coverage or retirement. As a result, government employees have had their pay raises stunted, have more being taken out of their paychecks, and have more out-of-pocket expenses for healthcare.

If you’re looking for legal protection against predatory lending practices, Wisconsin is one of the worst states you can live in. While the legal rate of interest is capped at 5% under Wisconsin Statute §138.04, it only applies if both a borrower and lender don’t agree to a higher rate in writing. In such cases, there is no maximum limit. Additionally, these protections only exist for people seeking a consumer loan. Payday lenders, whose goal is often to trap borrowers with recurring debts, are governed by far less strict rules.

Under Statute §138.14, payday lenders are able to charge whatever rate of interest they want, plus add an additional 2.75% rate per month on any late payments. Payday lenders may extend up to either $1,500 dollars or 35% gross monthly income to borrowers for 90 days or less. Additionally, there’s no limit on the number of loans a payday lending can grant a single customer, and one rollover is permitted per loan. This makes it exceptionally easy for lenders to charge several times more than the loan is worth, easily trapping people with terms they can’t possibly hope to repay.
