North Dakota Laws and Regulations for Bad Credit Personal Loans
North Dakota has an interesting way of determining the amount of interest that is considered the maximum rate. First, in the absence of a contract, the legal limit of interest allowed on a loan issued in the state is 6%. If the terms of the loan are recorded in writing, then the cap on permissible interest will be 5.5% above the interest rate on United States Treasury bills. This cap, however, can be no lower than 7% per year. If the above method of calculating interest does not reach 7%, the legal rate of interest becomes 7% (North Dakota Century Code § 47-14-05, § 47-14-09).
The exception to this is if a loan is issued in an amount exceeding $35,000. Then the rate becomes a matter of negotiation between the two parties and they must come to an agreement as to what they are each willing to accept (§ 47-14-09). If usurious lending is discovered, then the lender, as a penalty, may be forced to not only forfeit all remaining interest due on the loan, but it will also lose 25% of the loan’s principal (§ 47-14-10). For any interest that has already been paid, the borrower may be able to recover up to twice the amount paid in interest. Usurious lending also comes with a Class B misdemeanor charge.
